Terms of Service

The short version: DuoBudgets is a household budgeting tool currently in beta. Use it honestly and lawfully. Your financial data belongs to you. We provide tools, not financial advice, and the service is provided as-is.

1. Agreement to Terms

By creating an account or using DuoBudgets, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. We may update these Terms from time to time and will notify active users of material changes via SMS and in-app notice at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance.

2. Beta Service

DuoBudgets is currently in beta. The service is provided for testing and early-access use. Features may change, be added, or be removed. While we take reliability seriously, beta software may contain bugs. We appreciate your patience and feedback during this period.

3. Description of Service

DuoBudgets is a personal household budgeting application that allows you to plan income and expenses, track spending, connect bank accounts via Plaid, manage debts and investments, and coordinate finances with household members. DuoBudgets does not provide financial advice, investment recommendations, credit services, tax advice, or any regulated financial services.

4. Eligibility

You must be at least 18 years of age and a resident of Canada to use DuoBudgets. By creating an account you represent that you meet these requirements.

5. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. If you believe your account has been accessed without your permission, use Sign Out All Devices in Settings immediately and contact us. One account per person. You may not share your account with others or use another person's account without their permission.

6. Pricing and Free Access

DuoBudgets is currently free to use during beta. We reserve the right to introduce paid plans in the future. Active users will be given at least 60 days notice before any pricing changes take effect, with the option to export data before any paid tier begins. Free tier access (if introduced) will be clearly defined at that time.

7. Your Data and Intellectual Property

You own all budget data, financial entries, and content you enter into DuoBudgets. By using the service, you grant Simpsons AI Solutions Inc. a limited licence to store, process, and display your data solely for the purpose of providing DuoBudgets to you. We do not claim ownership of your data and will never use it for advertising or sell it to third parties. DuoBudgets, its design, code, and branding are owned by Simpsons AI Solutions Inc. and protected by applicable intellectual property law.

8. Bank Account Connection

Bank connectivity is optional and facilitated by Plaid Technologies Inc. Your bank credentials go directly to Plaid. They never touch our servers. The connection is read-only. You can disconnect at any time from Settings. By connecting a bank account, you agree to Plaid's End User Privacy Policy at plaid.com/legal.

9. SMS Communications and CASL

By providing your phone number and enabling SMS reminders, you expressly consent under CASL to receive transactional SMS messages from DuoBudgets including payment reminders and monthly budget summaries. You may withdraw consent at any time in Settings → Alerts or by replying STOP to any message. Standard message and data rates from your carrier may apply.

10. Acceptable Use

You agree to use DuoBudgets only for lawful, personal household budgeting purposes. You must not: attempt to gain unauthorized access to the service or other users' accounts; reverse engineer, decompile, or attempt to extract source code; use automated scripts, bots, or scrapers against the service; use the service for commercial purposes without written permission; impersonate another person or provide false information; upload malicious code or files; or use the service in any way that violates applicable Canadian law.

11. No Financial Advice

Nothing in DuoBudgets constitutes financial, investment, tax, or legal advice. All financial health scores, projections, surplus suggestions, and spending analyses are informational tools only and should not be relied upon as professional advice. Always consult a qualified financial professional for significant financial decisions.

12. Disclaimer of Warranties

DuoBudgets is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data will never be lost. We make no guarantees about the accuracy of financial calculations, bank balance syncing, or third-party data provided by Plaid.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Simpsons AI Solutions Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or financial losses arising from your use of or inability to use DuoBudgets. Our total aggregate liability for any claim relating to DuoBudgets shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 CAD, whichever is greater. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under applicable law.

14. Termination

You may delete your account at any time from Settings → Account → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to the service or other users. In non-emergency situations we will provide reasonable notice before termination. Upon termination, your data will be deleted as described in our Privacy Policy.

15. Force Majeure

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to service outages of our infrastructure providers (DigitalOcean, Plaid, Twilio, Cloudflare), internet failures, natural disasters, or government actions.

16. Changes to the Service

We reserve the right to modify, suspend, or discontinue any feature of DuoBudgets at any time. For material changes that remove core functionality, we will provide at least 30 days notice. In the event of permanent shutdown, we will provide at least 30 days advance notice via SMS and email, during which your data export will remain available.

17. Dispute Resolution

If you have a dispute with us, please contact us first at [email protected] and we will attempt to resolve it informally within 30 days. If informal resolution fails, disputes shall be resolved by binding arbitration in Saskatchewan, Canada under the rules of the ADR Institute of Canada, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You agree to waive any right to a class action proceeding.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict of law principles.
